General Terms and Conditions (GTC) for all orders placed on www.berkeyeurope.eu, www.berkeybelgium.be, www.franceberkey.fr and berkey.lu hereinafter referred to as Berkey Europe

Please find below the general terms and conditions of business (GTC), which serve as a basis for the processing and realization of the purchase contract of the customers on the websites of Berkey Europe. The data protection policies can be found in a separate document, also on the attached page.

The customer is any natural or legal person who enters into a transaction for commercial purposes, in particular through a secure online payment procedure implemented and managed by the banking institutions whose services Berkey Europe has contracted.

1. RECOGNITION OF THE CONDITIONS

The client accepts the general terms and conditions of sale (GTC) as soon as he/she initiates an order by clicking on "Order" and this for any order of products and/or services found on the Berkey Europe websites. The contractual relationship between Berkey Europe and the client shall be governed by European law. This document is an integral part of the sales contract.

2. CONCLUSION OF THE CONTRACT

2.1 Contracts concluded on the Berkey Europe websites shall be exclusively in the French language. When ordering items, your contracting party is A+B Solutions Sarl, Chemin de la Meunière 10, 1008 Prilly, Switzerland.

2.2 By clicking on "Order", you place a binding order for the items in your shopping cart. We will confirm the receipt of your order by e-mail after receipt of the full payment of the order. A contract shall then be concluded between the customer and Berkey Europe.

2.3 Please note that if you choose to pay by bank transfer, the order of the goods shall be effective upon receipt of the full payment for the goods and any shipping costs.

3. PRICES AND SHIPPING COSTS

3.1 The prices are displayed in Euro.

3.2 The prices indicated on the articles at the time of the order are applicable. The prices indicated are inclusive of all taxes. The price of the articles does not include the shipping costs.

3.3 The amount of shipping costs is calculated automatically according to the destination and content of the order. They are shown in the summary before the conclusion of the order.

3.4 We reserve the right to change prices at any time. The prices indicated at the time of the order are decisive.

4. PAYMENT

4.1 We give our customers the possibility to use different payment methods such as advance payment by bank transfer, payment by credit card, Paypal etc. For each order we reserve the right not to accept a payment method. Please note that we only accept payments from accounts in Switzerland and the European Union (EU). You are responsible for any cash transaction fees and exchange rates.

4.2 The order shall be deemed accepted by Berkey Europe when the banking institutions have given their approval and Berkey Europe has validated the order by sending a confirmation e-mail to the customer's address indicated on the order.

4.3 In order to limit fraud, Berkey Europe reserves the right to request proof of the client's address and identity before confirming the order. Berkey Europe also reserves the right to cancel the order in the absence of such proof or in the absence of data that is deemed to be incorrect.

4.4 In the event of a refund, we shall refund you to the account you used for payment.

5. DELIVERY

5.1 Unless otherwise agreed between the customer and Berkey Europe, the order shall be delivered to the delivery address indicated in the order.

5.2 We shall only be obliged to deliver items that are in our stock and those that we can order from our suppliers. We ship your orders within Europe. If the term is formulated in working days, we mean all days from Monday to Friday. This does not include Saturdays and Sundays as well as legal holidays.

5.3 The information given by the customer when placing the order (name, billing and delivery address) is binding. We are not responsible for any error made by the customer during the registration of his account or during the placing of his order.

6. RIGHT OF RETURN

6.1 For orders of articles on the websites of Berkey Europe, Berkey Europe shall accept a right of return of a total of 30 days from receipt of the goods (the period shall begin on the day following receipt). In order to exercise the right of return, the customer must not have used the goods, they must be returned whole and intact and in their original packaging.

To exercise this right, the customer must notify by e-mail, mentioning the order number and our support team will guide you through the process.

6.2 The costs of the return shipment shall be borne by Berkey Europe.

6.3 It is possible to exchange the goods if the customer is not satisfied. However, the customer must not have used the goods, they must be returned whole and intact and in their original packaging.

7. WARRANTY

7.1 The legal warranty of two years for defective products applies. During this period, the customer can request the repair or replacement of the defective product.

7.2 The products shall be guaranteed by their manufacturers for the period and in the manner indicated on the Berkey Europe websites. No warranty claims shall be possible beyond the period offered by Berkey Europe.

7.3 The warranty shall be excluded in the event of defects caused by the customer. This shall apply in particular in the case of improper handling or misuse.

8. CHANGES TO THE GENERAL TERMS AND CONDITIONS OF SALE

8.1 Berkey Europe reserves the right to change or adjust the general terms and conditions of business in the future if technical or legal reasons are necessary. Amendments shall become part of the contract if the customer accepts them.

8.2 If individual clauses of the contract are or become wholly or partly invalid, or if the contract has an unforeseen gap, the validity of the remaining clauses or parts of these clauses shall not be affected. Ineffective or missing clauses shall be replaced by the corresponding legal regulations.

9. PLACE OF JURISDICTION

In case of dispute, the place of jurisdiction is Lausanne.
